The electoral body has been working, with the support of state actors and stakeholders, to bring changes to the Election Act, 2011 so as to improve elections by ensuring that the processes are better aligned to the constitution and to address the challenges experienced in implementing the law.
The proposed law, to be known as Elections (Amendment) Bill, 2015, seeks to provide reasonable timeliness for the nomination process and resolution of disputes, change the education qualifications of candidates and give clarity on who qualifies to be classified under marginalized groups, among others. It proposes, for example, that a Member of Parliament must have a degree while a Member of the County Assembly will be required to have a post-secondary diploma for 2017 elections and a university degree for subsequent elections.
"We are still discussing that. We have not made a deal yet. It is a negotiation process, it is long drawn out, but we are still talking. There's the selection panel, and then others were saying we adopt what is in Article 215 with the necessary modifications. We are yet to agree on which path to follow," said Mr Chepkonga.
